Customers and Other Supporters Stand with Farmer!

Submitted by Kimberly Hartke

The FDA reign of terror against family farms who are serving the needs of private buying clubs is culminating in one Wisconsin farmer facing federal charges. Citizens deserve the freedom to choose, and are staging an event in support of this principled farmer, Vernon Hershberger. He is being dealt with unjustly, and is standing strong with the support of the families he serves. (Kimberly Hartke)

February 24, 2012–Baraboo, WI. Food sovereignty activists from around North America will meet at this tiny town on March 2, 2012 to support Wisconsin dairy farmer Vernon Hershberger and food sovereignty. Hershberger, who has a court hearing that day, is charged with four criminal misdemeanors that could land him in prison for three years with fines of over $10,000. The Wisconsin Department of Agricultural Trade and Consumer Protection (DATCP) targeted Hershberger for supplying a private buying club with fresh milk and other farm products.

DATCP has charged Hershberger with, among other things, operating a retail food establishment without a license. Hershberger repeatedly denies this, citing that he provides foods only to paid members in a private buying club and is not subject to state food regulations. “There is more at stake here than just a farmer and his few customers,” says Hershberger, “this is about the fundamental right of farmers and consumers to engage in peaceful, private, mutually consenting agreements for food, without additional oversight.”

At a pre-court rally scheduled for 11:00am, in front of the Sauk County Courthouse in Baraboo, food rights activists will read and distribute a “Declaration of Food Independence” that asserts inherent rights in food choice. A signing ceremony will be part of the rally. The signers expect the declaration will inspire a growing food sovereignty movement. Speakers at the rally will include members of Hershberger’s club.

Hershberger and other farmers around the country have been and are facing state or federal charges against them for providing fresh foods to wanting customers. In recent months the FDA has conducted several long undercover sting operations and raids against peaceful farmers and buying clubs that have resulted in farms shutting down and consumers without access to their food.

Farm Food Freedom Coalition wants to ensure that America’s treasures, our independent farms and ranches, are able to thrive. We aim to preserve our agricultural heritage and the future availability of traditional, farm fresh foods. Americans want and deserve the freedom to choose natural, unprocessed foods for generations to come.

Lab Rats and Book Worms

Posted by Joette Calabrese on February 26, 2012

NPR just released a story about how acetaminophen, an ingredient in Tylenol and other common meds, is causing asthma in some children.

These headlines have become familiar – even trite: Drugs are responsible for causing more serious disease than the disease(s) they were initially intending to “treat”. And how has this been discovered, after 40 years of Tylenol being successfully marketed as a safe, over-the-counter med?

Why, by having the public take it, of course!

We are lab rats, ladies and gentlemen, and as long as we take these over-the counter drugs, we are a part of the risky experiment to determine their safety.

This begs the question, should we comply with this kind of experiment?

Unwittingly “join in the data collection”.

Oftentimes, when our little ones gets a normal, childhood illness with a fever, we feel as parents that it is our duty to immediately eliminate all things uncomfortable. Many moms have been taught that we are supposed to, at all costs, get rid of that fever! We give Tylenol, the fever is gone, problem solved, right? Not so fast…

If this appeals to you, read no further. I’d like to offer a different viewpoint: The way we homeopathic moms view fever and symptoms in general, is that they are simply normal and healthy responses or signals of an inner imbalance. In fact, symptom means “sign”. When we remove the sign of illness, we are simply fooling ourselves into believing that the problem is solved.

Fever, in actuality, is a normal, healthy response to normal childhood illness and normal childhood illness is a building block for lifelong immunity. Forcing a fever away is not eliminating illness; it’s just abolishing the outward expression. It’s like unscrewing a noisy, annoying smoke alarm on the ceiling because we can’t be bothered with the sound; all the while, the fire blazes on the stove.

By eliminating the outward signs of a normal childhood illness with OTC drugs, not only are we eliminating helpful information, but we may even be putting our children at risk for chronic lifelong illnesses. In homeopathy, fevers from childhood illnesses are considered not just a symptom or a sign of inner imbalance but deemed curative! The heat that effectively emanates from a fever is intended to “cook” off the virus, not unlike a sauna is used to fend off illness.1

For me, it’s a no –brainer. When it comes to my children’s health, I’ll take a fever for a few days over the potential of asthma. Genuine health is accomplished by uprooting illness and not by treating symptoms. Putting out the fire is certainly more intelligent than removing the smoke alarm.

NPR reports that Johnson & Johnson, maker of Tylenol, stated the following: “There are no prospective, randomized controlled studies that show a causal link between acetaminophen, the active ingredient in Tylenol, and asthma”. So, do the manufacturers of Tylenol feel that it might be a good idea to “work” on their product? It sure doesn’t seem so. They need more data from us – the trusting and willing participants in their experiments

This, my friends, is the reason why I chose not to subject my family to the experimentation methods of the pharmaceutical industry and to learn homeopathy when my children were little. I simply didn’t want them to take antibiotics, acetaminophen or any other drug, for that matter. I am pleased to report that we were successful! My children are all full-grown and none of them have ever had any meds. I hasten to add that I didn’t ignore their illnesses; I simply employed homeopathy, nutrient dense foods and plain old horse sense.

I’ll admit it wasn’t always easy, bucking the trend of “a pill for every ill”. It took guts, pig-headed determination and self education to feel confident in this type of childrearing. I studied incessantly and grew to have confidence in my ability to take on my children’s illnesses. I would read, study, read more, memorize and then read some more after that! I was never without a homeopathy book on my lap and I’d read my notes into my tape recorder (it was the 80’s) and listened to my notes repeatedly.

I figured that if I have to associate myself with a fellow inhabitant of the animal kingdom, I’d choose a book worm rather than a lab rat!

Join me in learning homeopathy so you too, can enjoy self-reliant health. It’s satisfying, exhilarating and what I call “mom”-ifying to learn how to take care of our families the genuine way….by employing homeopathy.

Fight For Raw Milk!

CDC CHERRY PICKS DATA TO MAKE CASE AGAINST RAW MILK
Agency ignores data that shows dangers of pasteurized milk

WASHINGTON, DC, February 21, 2012. In a press release issued today, authors affiliated with the Centers for Disease Control claim that the rate of outbreaks caused by unpasteurized milk and products made from it was 150 times greater than outbreaks linked to pasteurized milk.” The authors based this conclusion on an analysis of reports submitted to the CDC from 1993 to 2006.

According the Weston A. Price Foundation, the CDC has manipulated and cherry picked this data to make raw milk look dangerous and to dismiss the same dangers associated with pasteurized milk.

“What consumers need to realize, first of all,” said Sally Fallon Morell, president of the Weston A. Price Foundation, “is that the incidence of foodborne illnesses from dairy products, whether pasteurized or not, is extremely low.  For the 14-year period that the authors examined, there was an average of 315 illnesses a year from all dairy products for which the pasteurization status was known.  Of those, there was an average of 112 illnesses each year attributed to all raw dairy products and 203 associated with pasteurized dairy products.

“In comparison, there are almost 24,000 foodborne illnesses reported each year on average.  Whether pasteurized or not, dairy products are simply not a high risk product.”

Because the incidence of illness from dairy products is so low, the authors’ choice of the time period for the study affected the results significantly, yet their decision to stop the analysis with the year 2006 was not explained.  The CDC’s data shows that there were significant outbreaks of foodborne illness linked to pasteurized dairy products the very next year, in 2007: 135 people became ill from pasteurized cheese contad with e. coli, and three people died from pasteurized milk contaminated with listeria (wwwn.cdc.gov/foodborneoutbreaks/Default.aspx).

Outbreaks from pasteurized dairy were also a significant problem in the 1980s.  In 1985, there were over 16,000 confirmed cases of Salmonella infection that were traced back to pasteurized milk from a single dairy.  Surveys estimated that the actual number of people who became ill in that outbreak were over 168,000, “making this the largest outbreak of salmonellosis ever identified in the United States” at that time, according to an article in the Journal of the American Medical Association.

According to Fallon Morell “In the context of the very low numbers of illnesses attributed to dairy in general, the authors’ decision to cut the time frame short, as compared to the available CDC data, is troubling and adds to questions about the bias in this publication.”

According to Fallon Morell, the CDC’s authors continue to obscure their study by failing to document the actual information they are using. They rely on reports, many of which are preliminary. Of the references related to dairy outbreaks, five are from outbreaks in other countries, several did not involve any illness, seven are about cheese-related incidents, and of the forty-six outbreaks they count, only five describe any investigations.

Perhaps most troubling is the authors’ decision to focus on outbreaks rather than illnesses.  An “outbreak” of foodborne illness can consist of two people with minor stomachaches to thousands of people with bloody diarrhea.  In addressing the risk posed for individuals who consume a food, the logical data to examine is the number of illnesses, not the number of outbreaks.

“The authors acknowledge that the number of foodborne illnesses from raw dairy products (as opposed to outbreaks) were not significantly different in states where raw milk is legal to sell compared with states where it is illegal to sell,” notes Judith McGeary of the Farm and Ranch Freedom Alliance.  “In other words, had the authors looked at actual risk of illness, instead of the artificially defined “outbreaks,” there would have been no significant results to report.”

This does not end the list of flaws with the study, however.  The link between the outbreaks and the legal status of raw dairy mixed an entire category of diverse products. Illnesses from suitcase style raw cheese or queso fresco were lumped together with illnesses attributed to fluid raw milk, a much less risky product.  In the majority of states where the sale of raw fluid milk is allowed, the sale of queso fresco is still illegal.  The authors had all of the data on which products were legal and which products allegedly caused the illnesses, yet chose not to use that data.

Similarly, to create the claimed numbers for how much riskier raw dairy products are, the authors relied on old data on raw milk consumption rates, rather than using the CDC’s own food survey from 2006-2007.  The newer data showed that about 3 percent of the population consumes raw milk—over nine million people–yet the authors chose instead to make conclusions based on the assumption that only 1 percent of the dairy products in the country are consumed raw.

The authors also ignored relevant data on the populations of each state.  For example, the three most populous states in the country (California, Texas, and New York) all allow for legal sales of raw milk; the larger number of people in these states would logically lead to larger numbers of illnesses than in low-population states such as Montana and Wyoming and has nothing to do with the fact that raw milk is illegal in those states.

“It would hardly be surprising to see some sort of increase in foodborne illnesses related to a food where that food is legal,” said McGeary.  “If we banned ground beef, we’d see fewer illnesses related to ground beef products.   Yet this new study fails to prove even that common-sense proposition, even as it claims to prove a great deal more.  What the data really shows is that raw dairy products cause very few illnesses each year, even though the CDC data indicates that over 9 million people consume it.”

School Lunch Controversy

Posted by Kevin Brown on February 20, 2012

Last week, CNN reported on a North Carolina school official inspecting a pre-schoolers homemade lunch for ccompliance with USDA dietary guidelines. The official took away the childs lunch and insisted that the child eat the cafeteria lunch which consisted of chicken nuggets.

The Weston A. Price Foundation (WAPF), a nonprofit nutrition education foundation, reviewed the 2010 government guidelines and declared that they provide inadequate nutrition for growing children. Specifically, the guidelines do not permit sufficient fat soluble vitamins, A,D, and K, and critical nutrients for neurological development, choline and Vitamin B-12.

WAPF President, Sally Fallon Morell suggests that the best way for children to get a decent lunch is for parents to make their own childs lunch with natural whole foods and send it to school. And, now we find that even homemade lunches are being targeted by the government for scrutiny!

Please see our press conference video Nutrition Experts Critique the 2010 USDA Dietary Guidelines.

Obesity, diabetes, bullying and school violence are problems that can all be attributed to poor nutrition. The Weston A. Price Foundation has issued an alternative set of guidelines, which it believes will help improve the mental health and physical well-being of our nation’s children. See Healthy 4 Life.

Sally Fallon Morell is based in Washington, DC and available to do interviews on the school lunch issue.

We can make her available from the National Press Club Broadcast Center, if that would be of interest.

Food Freedom

Posted by Kevin Brown on February 20, 2012

It is with much sadness that we report the two-year war waged by the U.S. Food and Drug Administration (FDA) against Pennsylvania Amish farmer Dan Allgyer has been a success. The Washington Times and others are now reporting that, following a ruling last month by Judge Lawrence F. Stengel that Allgyer could no longer ship raw milk across state lines, he is officially shutting down his entire Rainbow Acres Farm.

Provoking Allgyer to shut down his farm appears to have been the goal of the FDA all along, which back on February 4, 2010, conducted a gestapo-style raid on Allgyer’s Kinzers, Penn., property to search for evidence that he was shipping raw milk across state lines. After illegally trespassing on the man’s property, the agents proceeded to harass Allgyer about his supposed involvement in interstate commerce (http://foodfreedom.wordpress.com).

Just a few months later on April 20, 2010, the FDA again sent its Nazi-sympathizing thugs back to Rainbow Acres Farm, this time at 4:30 a.m. while Allgyer was still asleep, to conduct another raid. Violating the provisions of their so-called warrant, which specified that any inspection must be conducted during “reasonable times during ordinary business hours,” the agents proceeded to once again ransack the farm in search of evidence to back their claims that Allgyer was engaged in illegal interstate commerce (http://www.naturalnews.com/029322_raw_milk_Amish.html).

Following this second sting, the FDA claims to have discovered the evidence it needed, and immediately sent Allgyer a warning letter notifying him that he was in violation of interstate commerce laws, according to their view (http://www.farmtoconsumer.org/aa/aa-26april2010.htm). The agency also filed a civil complaint against Allgyer around the same time.

With hundreds of happy and satisfied out-of-state customers that relied on him for fresh supplies of raw milk, Allgyer attempted to satisfy the FDA’s demands by restructuring his farm’s distribution process into private cow share agreements with customers. Such agreements allow individuals to directly purchase shares in the cows from which they get milk, which means they personally own them, and they are not subject to FDA jurisdiction.

Rogue judge essentially declares FDA has jurisdiction over private property use, in this case cows

But on February 3, 2012, Judge Stengel decided that Allgyer was still in violation of interstate commerce laws, even with the restructured cow sharing arrangements, and ordered him to stop distributing raw milk altogether. Private cow share agreements do not constitute interstate commerce, of course, but Judge Stengel apparently pays no regard to individual liberty, having declared that the FDA basically now has jurisdiction over private property use.

Likely worn down from the perpetual and never-ending harassment, Allgyer appears to have decided to simply give up trying to fight this unprecedented tyranny, and simply shut down his farm. Hundreds of families that relied on Allgyer for fresh milk, butter, cheese, eggs, and other nutritious goods will now have to find a new source for clean food, at least until the FDA shuts them down, too.

“I can’t believe in 2012 the federal government is raiding Amish farmers at gunpoint all over a basic human right to eat natural food,” said one of the farm’s former customers, who wished to remain anonymous, to The Washington Times. “In Maryland, they force taxpayers to pay for abortions, but God forbid we want the same milk our grandparents drank.”

Gastrointestinal problems? Try Homeopathy!

Posted by Joette Calabrese on February 16, 2012

This is an excerpt from Joette’s latest book for her year-long, webinar course, How to Raise a Drug Free Family. Stay connected with Joette to receive updates on how you can register!

Vomiting, diarrhea, bloating, heartburn, flatulence. Those 5 words aren’t pleasant to hear or experience.

So, for those 5 awful words, let me offer you 3 homeopathic remedies that have been shown to address these and many other gastro-intestinal issues peacefully and powerfully.

Arsenicum album…This is the remedy to consider for food poisoning.  When vomiting and diarrhea are relentless, consider Arsenicum album.  There may be abdominal cramping and burning pain in the rectum.  Drinking even the smallest amount of water which is so craved will cause vomiting.  Most of this appears after midnight and the desire for company is profound.  The illness exhausts and there’s internal coldness that is difficult to alleviate.  Bundling under the covers is common despite the fever that ensues.  The sufferer is restless with frequent changing of position and fears the illness is fatal.

Nux vomica…Use Nux vomica when illness is brought on by stress or over-indulgence.  Read further in the Materia medica and other areas of this guide to flesh out your understanding of this important remedy.  Common symptoms include heartburn, nausea, dry retching, gassiness, and bloating.  The person wishes he could just vomit to get it over with.  Sometimes this comes to fruition, other times not.  The same holds true for bowel movements.   It feels as though he would feel better if only he could just “go”, yet is only able to pass a small amount of stool.  There may be an accompanying headache and almost always there’s irritability.  Morning is the worst time for this person, almost like a hangover from a party the previous night.

Sulphur has an issue with appetite; sometime there is a complete loss of it, while other times it is excessive.  Food often tastes too salty and there’s a desire for sweets.  In fact, the sufferer may feel weak and faint about 11 a.m. if he’s hungry.  Water can often fill the bill so that the appetite is satisfied.  In children, we also see that the child might refuse food altogether and only be interested in drinking.  The abdomen is sensitive to pressure with a sensation as though something in it is alive.  Morning diarrhea drives the person out of bed and there’s a feeling of rawness or soreness somewhere in the gastrointestinal tract.

When administering any of these 3 remedies, give 1 dose (4 pills), every 3-4 hours, and up to 4 doses. Stop when there’s significant improvement. However, if there’s no improvement after 4 doses, then discontinue administering that remedy and re-evaluate the symptoms to find the best remedy.

Soy for Valentine’s Day? Better Bypass This Idea!

Posted by Kaayla T. Daniel, PhD, CCN on February 14, 2012

The Soyfoods Association of North America suggests we serve lots of  “great tasting and great-for-you soyfoods” this Valentine’s Day “to protect the hearts of those we love.”   What’s more, SANA offers some naughty suggestions to make this day memorable for lovers.  To wit:

  • Surprise your sweetie by making them breakfast in bed; heart-shaped pancakes made with soymilk and topped with fresh fruit will start their day off right.

Interesting idea there –  making “them” breakfast in bed.   How hot is that?   Is SANA suggesting a threesome or an orgy?   Or perhaps a cardio morning of trotting quickly from one sweetie’s bed to the next?   Naughty minds want to know.

  • Plan a picnic in the park; pack sandwiches made with veggie deli slices and soy cheese for a high protein, low saturated fat, cholesterol free meal.

With soy many picnic possibilities, how will we ever pick?   Phoney Baloney,  Approximeat, Mockwurst, Soyloin, Roast Almost, Soysage, Nauseage, Misteak, Veat, Sham Ham, Wham, Tuno, Fakin’ Bakin, Soylent Green?    Gotta love all those veggie deli slices and soy cheeses high in “healthy” ingredients such as MSG (hiding under the aliases “natural flavors,” “spices” and “autolyzed yeast extract”), hexane-extracted soy protein isolate,  wheat gluten or vital wheat gluten, wheat starch, carrageenan, canola oil, soybean oil  . . .     With ingredients like that, the Naughty Nutritionist is not jesting but dead serious when she says “Hide the soylami!”

  • Coffee shops are the perfect place for an afternoon date; go for the soymilk option when ordering your favorite beverage.

And a good strong cuppa Joe might be just the thing to help hide the beany flavor and dingy color of soymilk, a product made palatable only because of its high sugar content.   Soymilk also offers cheap vitamins and minerals such as hard-to-absorb forms of calcium and vegetarian Vitamin D2 that’s been linked to hyperactivity, coronary heart disease and allergic reactions.

  • There’s nothing more romantic than a home-made meal; set the mood by serving spaghetti and meatless meatballs with a glass of wine by candle light.

Love those meatless balls made out of textured vegetable protein, soy protein isolate, soy protein concentrate, wheat gluten, wheat starch, soybean oil, caramel color,  MSG (hiding in the guise of “natural flavorings,” “hydrolyzed protein,” “yeast extract” and “spices”),  dextrose, and even cultured dextrose.    Warning to devout vegans:  some brands of “meatless meatballs” contain egg whites.  On the plus side, they might also contain carrots, perhaps leading a romantic partner to say “What’s up, Doc?”

Needless to say,  the soy industry would have us believe the “goodness of soy” outweighs any possible risks associated with MSG and the other fine ingredients.   Our FDA, after all, allowed a soy/heart disease health claim back in 1999 though the European Food Safety Authority has rejected such a claim three times, making the “soy industry’s blood boil,” according to the newsletter NutraIngredients.    In fact, the body of evidence (http://www.westonaprice.org/soy-alert/soy-heart-health-claim) has established that soy protein does not prevent heart disease, does not reliably lower cholesterol, may raise homocysteine levels,  and has even been linked to heart arrhythmias, cardiomyopathy and endothelial damage in women.

As for affairs of the heart, soy actually has a reputation as a libido downer.   Rather than promote soy as a sexy food for Valentine’s Day, the Soyfoods Association of  North American missed a fine opportunity to push soy for President’s Day.   What better food than soy for politicians with the “zipper problem”!!!

Long Winters, Hello Cod Liver Oil

Posted by Joette Calabrese on February 9, 2012

Where’s the sun?

Oh, those dreary, sunless, taupe-colored months.  It’s just about this time of year when I wish I could fill up my battery bars with some revitalizing sun.

But without our free source of vitamin D, we’re left to fend for ourselves to keep vitamin D levels adequate.

No one wants the winter blues and it’s well established that they result from a deficiency of vitamin D, present in soluble fats.

How can we be certain that our families are getting enough vitamin D in their diet without relying on the so-called “fortified” cereals, milks and synthetic vitamins?

As a homeopath who teaches mothers and others how to maintain and restore heath, I often suggest using lard in baking (like our grandmothers’ pies!) and in sautéing.  I also teach folks how to employ homeopathic remedies, such as Calc phos 6x, to help promote the proper absorption of nutrients.

All good stuff.

But truly, the easiest way to sustain vitamin D in the winter is to take fermented cod liver oil daily.

Yet, I’ll share a secret.  I teach my clients that cod liver oil is essential even in the warmer months.   Why? Because no matter how often our children are outside and getting vitamin D from the sun, they will not receive a priceless source of nutrition – liver, itself. Quite simply, liver contains more nutrients, gram for gram, than any other food!

It took me years to learn the importance of the consistent habit of eating liver, particularly that from a clean source.  Yet, when I was raising my children, it was nearly impossible to get liver into them.  After years of pâté, liver smothered in bacon and onions, and many turned up noses, I simply had to find a simple solution. Desiccated beef liver, available from Radiant Life in both powder and capsules, provides a convenient way to obtain all the legendary health and nutritional benefits of liver.

It can even be sprinkled into soups and stews and served to unsuspecting recipients of this sacred food!

Getting back to the importance of fermented cod liver oil…

Fermented cod liver oil is a time-tested method for consuming these most precious nutrients. Our ancestors instinctively understood the importance of daily cod liver oil long before the studies substantiated the findings.

My Italian grandmothers raised their large and robust families on such fare. When there was barely enough money for milk during the depression, they made certain that their children at least had cod liver oil. Fermented cod liver oil wasn’t available to them, but at least plain cod liver oil was.

Fermented cod liver oil is packed with fat-soluble vitamin D, which helps promote bone and teeth growth, as well as building immunity. Additionally, it supports healthy body weight and encourages brain development and lung function.

The high quality fermented fare wasn’t available in capsules when my children were young.  So, I incorporated a nightly ritual of taking cod liver oil with a tall glass of fresh milk.  My boys affectionately dubbed it the “spoon of doom”.

It made it more fun.

Things are different today. Now, my sons are young men and they take their fermented cod liver oil daily on their own.  In fact, while in college, they often doubled up on their doses while studying for exams.  The results were always high grades.

Radiant Life makes these age-old products available, and I make the recommendation to all my students/clients and anyone who asks, to take advantage of this near perfect food. For those who wish to avoid the cod liver oil’s taste, fermented cod liver oil capsules are the answer to skipping over the “spoon of doom”.

No need to let those clouds keep you and your family down this season. Instead, make Fermented Cod Liver Oil part of your daily routine and you’ll keep your brain sharp and your smile sunny, too.

FDA Says NoTo The Senators Who Drafted DSHEA

Posted by Kevin Brown on February 8, 2012

According to our sources, the rogue agency is digging in its heels on the NDI draft guidance that threatens so many supplements, refusing to listen to Congress or follow the intent of the law.

Senators Orrin Hatch and Tom Harkin met with Dr. Daniel Fabricant of the FDA on January 26 to request that the FDA withdraw its NDI draft guidance altogether—a meeting that ANH-USA, together with some trade groups, helped set up. They were following up on their recent letter to FDA Commissioner Margaret Hamburg asking the FDA to stop the process altogether, withdraw the guidance, and start again after meeting with interested parties to address the list of significant concerns expressed by consumers and industry.

You may recall that the landmark Dietary Supplement Health and Education Act of 1994 (DSHEA) required that guidelines be established for supplement manufacturers to notify FDA when a new dietary ingredient was introduced into the marketplace. The FDA’s Draft Guidance for New Dietary Ingredients was supposed to fulfill that requirement.

Unfortunately, the FDA’s proposed regulations are in fact completely contrary to the intent of Congress when DSHEA was passed, and Sens. Harkin and Hatch wanted to make that clear to FDA. They should know—they were the two principal authors of the legislation!

According to our sources, FDA has turned down the senators’ request. FDA in effect said that it is refusing to reconsider its interpretation of what the NDI section of DSHEA means, regardless of what Sens. Hatch and Harkin say they meant when they wrote the law.

Does this mean FDA intends to use the NDI process as a de facto pre-market approval system—something which regulatory observers believe was specifically excluded by DSHEA? In a word, yes. We have been told that FDA claims the NDI process is the only “preventive control” for dietary supplements in federal law. Whatever “preventive control” means, it is completely untrue that supplements are uncontrolled under federal law or that the FDA lacks the power presently to regulate them.

In refusing to follow the intent of the law as clearly stated by the law’s authors, the FDA is acting as a rogue agency. If you haven’t done so already, please ask your legislators to make a one-minute floor speech opposing the FDA’s guidance document. FDA’s plan would sweep many supplements off the shelf and make the ones that survive much more expensive.
