| NEWS RELEASE FDA SALAMI-SLICE STRATEGY CONTINUES

The Food and Drug Administration (FDA) has continued to turn a deaf ear to consumers and their health in pushing forward its agenda to remove thousands of safe supplements from the American marketplace The FDA is Deaf and Dumb Daniel Fabricant, Ph.D., the director of the Division of Dietary Supplement Programs at the FDA, again has stated that the Agency has no intention of withdrawing its proposed Draft Guidance for New Dietary Supplement Ingredients (NDIs) that it published last July. The FDA has not changed its position despite receiving over 7,000 comments on the draft industry guidance, which would subject many thousands of supplements to very expensive, drug-like testing and approval requirements in order to stay on store shelves. Fabricant says “alternative approaches” by the FDA to satisfy the FDA’s proposed requirements in the NDI Guidance might be reviewed. However there was no clarification on whether the requirements imposing prescription-drug-like clinical testing and scientific testing to gain FDA approval for supplements sold since 1986 and in the future would be subject to amendment, or dropped from the Guidance. He had previously implied that it could take 3-4 years to resolve these issues but now says the timeline “is really up in the air.” Fabricant’s comments can be read at http://www.nutraingredients-usa.com/Regulation/Fabricant-on-NDI-draft-guidance-Thanks-for-your-146-000-pages-of-comments.-We-ll-get-back-to-you. Interestingly enough, before joining the FDA in February 2011, Fabricant was a vice president with the Natural Products Association (NPA), which makes it very clear that Fabricant has abandoned his obviously sparse roots along with whatever understanding he ever had of the industry. The FDA Blames Industry & Punishes the Consumer More telling about the FDA’s strategy for more heavy-handed regulation is the statement that “If you look at the numbers of NDI submissions versus the number of supplements introduced to the market since 1994, it would appear there is a significant lag in compliance.” On its face, the marketplace has changed over the last seventeen years. But who is responsible for this 17-year lag in compliance? The Dietary Supplement Health and Education Act of 1994 (DSHEA) required manufacturers to submit pre-market notification applications for supplements and new ingredients when there is a history of use or other evidence establishing that an ingredient is safe when used as directed. The FDA has 75 days to accept or reject the application. A non-decision by the FDA means that the Agency accepts the evidence and that the product has complied, is approved, and can be marketed to the consuming public. Alternatively, a formal petition for a review and FDA issuance of an order prescribing the conditions under which a new dietary ingredient can be used and reasonably be expected to be safe, with the FDA having to respond within 180 days, can be filed. Again, shouldn’t a non-decision on a petition be considered as final Agency approval? If the Agency does not issue a decision either way, or if it cannot find a decision that was issued over the previous seventeen years, has it been the industry or the FDA itself who has not been in compliance with DSHEA? Apparently, the FDA believes that manufacturers and suppliers have not met the FDA’s own self-interpreted DSHEA burden of proof standard to show to the FDA that there is reasonable evidence that supplements and new ingredients in supplements are safe. The NHF believes, based upon the DSHEA law language, that this is a total misapplication of the DSHEA burden-of-proof standard. The burden of proof has been, and is on, the FDA to prove that supplements, which they have de facto approved through the pre-marketing notification process, are unsafe in the post-marketing stage of consumer use. Since DSHEA, there have been seventeen years of additional historical use-safety experience conducted by many millions of Americans. The FDA is choosing to ignore evidence and is attempting to paint this as non-compliance. In other words, it has not done its job but instead claims that it is not the FDA’s fault – instead, supplement consumers and industry should pay the price. Take Action Now The NHF has created a solution for all of us to rally behind – the Dietary Supplement Protection Act (DSPA) as H.R.3380. Some timid souls in the industry cower in a corner, saying they are afraid to support this bill because it will “open up DSHEA.” In case they had not already realized it, DSHEA gets “opened up” by our anti-health-freedom opponents each and every year with their new legislation! Are we to be nothing but cowards when we have the chance to regain some of our own freedoms? The NHF isn’t and knows that we need to be as bold as, even bolder than, our opponents. Both companies and consumers must support H.R.3380, especially when Congress gets back to work in mid-January 2012. The bill changes a key date in the DSHEA law that will save thousands of our supplements. It does this by acknowledging and using in our favor the new regulatory environment for supplements as well as supplements’ incredible safety record. It will put FDA bureaucrat’s feet to the fire and an end to their seventeen-year efforts to salami-slice the DSHEA law to fit their own public-policy agenda for dietary supplements. Internal Documents Reveal USDA Dietary Guidelines Panel
Dominated by a Profession Under Fire
Washington, DC–December 15, 2011–Under pressure from the Healthy Nation Coalition, the USDA recently revealed the identities of the 2010 Dietary Guidelines Independent Scientific Review Panel, which is credited with peer-reviewing the Guidelines to ensure they are based on the preponderance of the scientific evidence available. Seven out of the eight panel members are Registered Dietitians (RDs), chosen according to the USDA, for their knowledge in nutrition communication and dietary guidance.
At the same time, RDs across America are reeling from the news that the Centers for Medicare and Medicaid Services (CMS) will not reimburse them to provide intensive behavioral counseling for obesity. While the Federal government appears to be relying on RDs as experts in the midst of Americas obesity crisis, it doesnt want to pay them to help people lose weight. This news comes as the American Dietetic Association (ADA)the professional organization for RDsis under scrutiny for its ties to food and pharmaceutical industries.
An ongoing investigation by Congress recently revealed that the ADA receives over $1 million a year in payments from pharmaceutical companies and an undisclosed amount from companies such as Coca-Cola, PepsiCo, and Hershey. In addition to receiving payments from industries with obvious conflicts of interest, earlier this year the Alliance for Natural Health-USA revealed that ADAs continuing education courses for RDs are being taught by the Coca-Cola Companys Beverage Institute, stated Darrell Rogers from Alliance for Natural Health-USA. RDs have voiced their dissatisfaction with the ADAs corporate ties, with members indicating that the ADAs relationship with corporate sponsors has a negative impact on the public image of RDs and undermines the credibility of the profession.
Credibility has been further undermined by the lack of evidence that the methods RDs use to treat obesity are effective. The ADAs own Evidence Analysis Library contains few studies that demonstrate that dietitian-led dietary interventions result in meaningful weight loss.
As a result, many insurance companies, and now CMS, do not reimburse RDs for its treatment. Tennessees state insurance doesnt cover seeing a dietitian for weight loss. Why? There’s really no evidence to support the fact that providing those services would result in a decrease in medical cost, certainly not immediately, and even in the longer term,” according to Dr. Wendy Long, chief medical officer of TennCare.
This lack of evidence may be due in part to the limited scope of dietetic education and practice. The ADA relies on the USDA as a scientific authority and follows its lead in most matters of nutrition, limiting the training of RDs to USDA-approved diet recommendations.
Valerie Berkowitz, RD, Director of Nutrition at the Center for Balanced Health and author of the award-winning nutrition guide The Stubborn Fat Fix states: “Registered Dietitians lack education and practice in manipulating macronutrients [protein, fat, and carbohydrate] to switch fuel sources from carbohydrate to fat burning. It is unfortunate that educators do not acknowledge the therapeutic value of lower carbohydrate consumption at least as an additional tool to increase the success of medical nutrition therapy for obesity prevention and treatment.
The ADA not only limits the training of RDs, it is sponsoring legislation in New York and multiple other states that would essentially restrict the practice of nutrition to RDs, and outlaw highly-qualified non-RD nutrition professionals from practicing. If successful, this would restrict consumer choice of nutrition professionals to those trained to follow USDA recommendations.
Given the ADAs close ties with the food and drug industry and the lack of effectiveness for USDA-approved dietitian-led interventions for obesity, the public should be concerned about the dominant role that RDs and other ADA members played in the creation of the 2010 Dietary Guidelines. In addition to the Independent Scientific Review Panel being comprised primarily of RDs, ADA members were also one-third of the Dietary Guidelines Advisory Committee, the group of experts that creates the Report that guides the writing of the Dietary Guidelines. The majority of the USDA and HHS staff members who worked with the Committee or on the Dietary Guidelines are also RDs.
According to Adele Hite, Director of the Healthy Nation Coalition and lead author of a 2010 peer-reviewed article examining the limitations of the Dietary Guideline process, The ADA is an industry-friendly organization. The USDA appears to rely on the dietetics focus of ADA-trained Registered Dietitians to confirm their own industry-friendly guidelines. The self-supporting relationship between the ADA and the USDA does not benefit either the credibility of RDs or the health of Americans.

Procedure for hearing:
- Please submit your written testimony (multiple copies if possible) to the committee aide before the meeting starts.
- Please fill out a witness slip to indicate your support for the bill, and use the checkboxes to indicate if you wish to speak.
The committee chair asked doctors to speak first, both pro and con, and then had to hear other bills before adjourning to get to other committee meetings in a timely fashion. Many people with prepared testimony were not called to speak on Monday and I appreciate your frustration because I was one of them. Please come back and submit your testimony in writing before the meeting so all voices can be heard.

U.S. Congress to Screen Farmaggedon and Film Plays Again in Chicago

December 6, 2011–Washington, D.C.– Independent filmmaker Kristin Canty announces today that her film is being screened next week for members of Congress, and the shocking new food documentary was invited back for an encore run at Chicago’s prestigious Gene Siskel Film Center. This summer’s theatrical releases in Washington, DC, Los Angeles, San Francisco, New York City, Chicago, and Boston garnered critical acclaim, and grassroots interest spawned 150 community screenings around the country.
The film opens in Chicago on Saturday, December 10 through the 12th, for one show daily, with a final show on Thursday the 15th. See Gene Siskel Center website for showtimes. The Congressional screening event will take place on Capitol Hill on Tuesday, December 13, 5:30 pm in the Orientation Theater North. Farmageddon, The Unseen War on American Family Farms, vividly conveys the stories of numerous farmers who found themselves on the wrong side of government food policy. It is hard to imagine our government using S.W.A.T. raids to deal with misdemeanors, nor is it easy to fathom agents of the law seizing valuable farm products and equipment, particularly in cases where there is no proof of harm. This movie enables audiences all across America to come face to face with harsh realities of farm life in our modern day.
Filmmaker Kristin Canty says, “I am very grateful to the Gene Siskel Center for bringing the film back. We had a number of sold out shows in our brief run there this summer. Now more Chicagoans will have the opportunity to see the film!”
Canty’s film project may also have an opportunity to influence public policy. The gravity of the plight of small farmers has gotten the attention of our politicians in Washington, D.C. Congresswoman Chellie Pingree (D, ME) and Ed Perlmutter, (D, CO), and Congressman Ron Paul, (R, TX) are sponsoring the Congressional screening of Farmaggedon on Capitol Hill. Pingree, who is also an organic farmer, wants her colleagues to see the devastating effects regulatory policies are having on small American farms.
Pingree serves on the Agriculture Committee and recently introduced H.R. 3286, the Local Farms, Food and Jobs Act, which reforms agriculture policy to give consumers greater access to local foods, and gives farmers more opportunities. The bill is co-sponsored by 60 of her colleagues in the House, and has also been introduced in the Senate.

Mothers, Acting As ‘Agents,’ To Defy FDA Warning
Against FDA Prohibitions, Freedom Riders Will Publicly
Distribute over 100 gallons Raw Milk to Waiting Mothers
Chicago, IL—On December 8, a group of mothers and others will defy the U.S. Food and Drug Administration’s (FDA) ban on “distributing” fresh milk across state lines by transporting 100 gallons of raw milk from Wisconsin to Chicago’s Independence Park and distributing it to customers waiting at the park. Rally time is 11:30am – 2:00pm.
Federal law 21 CFR § 1240.61 prohibits interstate movement and distribution of raw milk for human cons
umption. The FDA regulation applies to individuals, or “agents” acting on their behalf.
Over the past year, the FDA and state authorities have conducted undercover sting operations on, raided and prosecuted farmers, buying clubs, and individuals who help distribute raw milk and other farm fresh foods. Over a dozen people and businesses currently face charges, orders, and other enforcement actions; some are under “federal criminal investigation” and face possible indictment by a grand jury. Several small cheese producing dairies with no history of making anyone sick have been put out of business by the FDA’s actions.
“It is a God-given, inalienable right to engage in direct, private transactions with our food producers,” says Max Kane, director of a Chicago area local-food-buying club. “Americans deserve to know that the FDA is using their tax dollars to target and prosecute independent, peaceful, farmers and their customers.”
Mothers from around the country, determined to protect their families’ food supply, launched the Raw Milk Freedom Riders with an inaugural ride on November 1 when they transported raw milk from Pennsylvania to the FDA’s headquarters in Silver Spring, Maryland, and distributed the milk to crowds gathered for a protest. In response the FDA issued a statement saying it does not “intend” to take “enforcement action against an individual who purchased and transported raw milk across state lines solely for his or her own personal consumption.”
The Freedom Riders say that the FDA’s statement leaves the door open for FDA to pursue farmers, buying clubs and individuals acting as “distribution agents.” The Wisconsin to Chicago Raw Milk Freedom ride will challenge the FDA’s use of force against raw milk distribution.
Media are invited to ride along as embedded reporters to witness the FDA’s reaction to the Freedom Riders’ standing up for their rights.
